If the value is over $500 then the charges will be upgraded to a 3rd degree crime of shoplifting which is punishable by up 3 – 5 years in prison. Under certain circumstances, a shoplifting can even be upgraded to a 2nd degree robbery punishable by 5 – 10 years if, at any time, physical force is used during the commission of the crime or the flight after. This often happens when someone suspected of shoplifting gets in a physical altercation with a security guard.
