Union Twp NJ Simple Assault Lawyer

A Union County man from Plainfield was indicted on charges today after he allegedly assaulted two police officers during a drug arrest. According to the police report, the defendant tried to punch, bite and spit at the cops after he was stopped and then took off running to try and lose the police on foot.

The detectives stopped the defendant as part of a narcotics investigation and then attempted to arrest him after finding a bag of cocaine on the ground where he was standing, according to the police report. A struggle then ensued between the police officers and the defendant who had to use pepper spray on him and even punched the defendant in the face several times to try and subdue him. As the struggle continued the man ripped off his shirt and ran a short distance before the officers finally tackled him. However, both officers sustained shoulder injuries while fighting on the ground with the defendant, according to the police report. The suspect refused to give up and actually tried biting the cops again while on the ground. Eventually back up showed up and the defendant was arrested. One of the officers, who first tried to arrest the defendant, required medical assistance and was brought to SomersetMedicalCenter for treatment, the affidavit states.

The defendant was indicted on two counts of aggravated assault on a law enforcement officer, resisting arrest, and possession of a controlled dangerous substance. A Simple Assault will automatically be upgraded to an Aggravated Assault if the victim was a law enforcement officer. Aggravated Assault of a Police Officer is a very serious charge and is graded as a third degree indictable offense which is punishable by 3 – 5 years in state prison. If you have been charged with aggravated assault on a police officer it is important that you speak with an experienced criminal defense attorney who can advise you of your rights and options.
